Terms of Use

By accessing or using the Site, creating a Platform account, or otherwise using any SuretyForge service, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not access or use the Site or Platform.

SuretyForge builds and operates a surety-bond agency management platform used by insurance agencies, the surety carriers they place business with, and the principals those agencies serve. The Site is our public marketing and informational website. The Platform is our authenticated software application, made available to registered agencies, carriers, and their users under a separate subscription or partner agreement.

SuretyForge is a technology provider. Bonds referenced or facilitated through the Platform are underwritten and issued by licensed surety insurance carriers, not by SuretyForge.

You must be at least 18 years old to use the Site or Platform. If you are using the Platform on behalf of an agency, carrier, or other organization, you represent that you are authorized to act on that organization’s behalf and to bind it to any applicable agreement.

Platform access requires a registered account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at the contact address below if you suspect unauthorized access to your account.

When using the Site or Platform, you agree not to:

• use the Site or Platform for any unlawful, fraudulent, or deceptive purpose;
• attempt to access accounts, bonds, or data belonging to another agency, carrier, or individual without authorization;
• submit false, misleading, or fraudulent underwriting, bond, or identity information;
• interfere with, disrupt, or attempt to gain unauthorized access to our systems, networks, or security measures;
• reverse-engineer, decompile, or scrape the Site or Platform, or use automated means to access them without our written permission;
• upload viruses, malware, or other harmful code; or
• misuse the Platform’s messaging or SMS features to send unsolicited or unauthorized communications.

The SuretyForge name, logo, “forge” marks, and all content, design, and software that make up the Site and Platform are owned by SuretyForge Inc. or our licensors and are protected by U.S. and international intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for its intended informational purpose and, where applicable, to use the Platform under the terms of your organization’s subscription or partner agreement. No other rights are granted.

The Site and Platform may reference or link to third-party services — including surety carriers, payment processors, and integration partners. We do not control and are not responsible for the content, policies, or practices of any third party.

The Site and Platform are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site or Platform will be uninterrupted, secure, or error-free.

SuretyForge is a technology platform and is not a licensed insurance carrier. We do not underwrite, guarantee, or issue surety bonds ourselves — bonds are underwritten and issued by the licensed surety carriers identified within the Platform.

To the fullest extent permitted by law, SuretyForge Inc. and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Site or Platform, even if we have been advised of the possibility of such damages. Our aggregate liability for any claim arising from these Terms or your use of the Site is limited to the greater of one hundred dollars ($100) or the amount you paid us, if any, in the twelve months preceding the claim.

You agree to indemnify and hold harmless SuretyForge Inc. from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Site or Platform.

These Terms are governed by the laws of the State of Oregon, USA, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Site or Platform will be brought exclusively in the state or federal courts located in Marion County, Oregon, and you consent to the personal jurisdiction of those courts.

We may revise these Terms at any time. The “Last updated” date above reflects the most recent revision. Continued use of the Site or Platform after changes take effect constitutes acceptance of the revised Terms.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy and SMS Terms & Messaging Consent, constitute the entire agreement between you and SuretyForge regarding the Site.
